By purchasing a membership, personal training you agree to the terms, conditions & media release waiver form. Once a payment for membership or service is made there will be NO REFUNDS or prorated amount. ALL memberships &/or packages are NON-REFUNDABLE / NON- TRANSFERABLE.
I represent and acknowledge by my purchase I will be utilizing training with MVPPERFORMANCE. At all times in this Agreement, any reference to MVPPERFORMANCE means (“MVPPERFORMANCE, "MVP" or "us" or "our" or "we”) all of which are referred to collectively as MVPPERFORMANCE. I represent and acknowledge by my purchase that I am at least eighteen years of age as of the date of your registration; and, (b) have the capacity to enter into a legally binding contract or have a parent or legal guardian enroll on behalf of minor. I acknowledge that I am agreeing to this Release, Waiver of Liability and Hold Harmless Agreement on my behalf and I agree to be bound by the terms of this Release, Waiver of Liability and Hold Harmless Agreement. In consideration of being permitted to train, I agree to the following:
Assumption of Risk: I acknowledge that using the Facilities, Site Locations and Equipment may expose me to hazards or risk that may result in my illness, personal injury or death and I understand and I accept all risk to my health, including any injury or death that may result. I recognize and acknowledge that certain risks of harm are or may be physically strenuous activities and certify by my signature that I am physically fit and able to participate and I know of no medical reason why I should not participate. I agree that while making use of the Facilities, Site Locations and Equipment, I will abide by the rules and guidelines set forth by MVPPERFORMANCE and to adhere to all other applicable rules, regulations, and laws. I pledge that I will not consume illegal drugs at any time while making use of the Facilities, Site Locations and Equipment and will not attempt to make use of the Facilities, Site Locations and Equipment while I am under the influence of alcohol or non-prescribed drugs. I understand that MVPPERFORMANCE will not be responsible for any medical expenses associated with any property or personal injury I may sustain.
Release: In consideration of MVPPERFORMANCE permitting me to use the Facilities, Site Locations and Equipment as set above, I release MVPPERFORMANCE, its Board of Trustees, director, officers, instructors, employees and representatives from any and all liability to me, my personal representatives, estate, heirs, and assign for any and all claims, demands and causes of action for any and all loss of personal property, illness or injury to me including my death, arising out of, resulting from, caused by, occurring during or in any way connected with the use of Facilities, Site Locations and Equipment, including injuries caused by negligence of MVPPERFORMANCE and/or its Board of Directors, officers, employees, trainers, coaches, and representatives, or any other participant that may be sustained by me while making use of the Facilities, Site Locations and Equipment, or while on the premises owned or leased by MVPPERORMANCE or any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in Training, Facilities, Site Locations or Equipment.
Indemnity, Hold Harmless, and Waiver.
I further agree to indemnify and hold harmless, waive and covenant not to sue MVPPERFORMANCE, and its Board of Trustees, director, officers, instructors, employees and representatives from any and all liability to me, my personal representatives, estate, heirs, and assign for any and all claims, demands and causes of action for any and all loss of personal property, illness or injury to me including my death, arising out of, resulting from, caused by, occurring during or in any way connected with the use of Facilities, Site Locations and Equipment, including injuries caused by negligence of MVPPERFORMANCE and/or its Board of Directors, officers, employees, trainers, coaches, and representatives, or any other participant that may be sustained by me while making use of the Facilities, Site Locations and Equipment, or while on the premises owned or leased by MVPPERORMANCE. It is my express intent that this Covenant Not to Sue and Agreement to Hold Harmless shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representatives, if I am deceased, and shall be governed by the laws of the State of Texas.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND THAT IT IS A RELEASE, WAIVER AND HOLD HARMLESS OF LIABILITY OF ALL CLAIMS AND CAUSES OF ACTION FOR ANY INJURY OR DEATH THAT OCCURS WHILE PARTICIPATING IN TRAINING, THE USE OF FACILITIES AND EQUIPMENT AMD IT OBLIGATES ME TO INDEMNIFY THE PARTIES NAMED FOR ANY LIABILITY FOR INJURY OR DEATH OF ANY PERSON AND DAMAGE TO PROPERTY CAUSED BY MY NEGLIGENT OR INTENTIONAL ACT OR OMISSION.
This document will be considered effective on the date purchased and shall be governed by the laws of the State of Texas.
